General Animal Ordinances that affect Breeders

Section 2.07 Nuisances of the Animal Code: Citizens breeding animals may not keep or operate their program in a manner that allows the animals and/or operation to become a Nuisance.

Section 3.06 Breeding of Dogs or Cats – Animal Code: It is a violation if the owner of a female dog or cat fails to confine the animal in an anti-escape enclosure while in season to where that animal can come into contact with another animal of the same species and opposite sex except for planned breeding purposes.

Section 5.01 Sale and Care of Certain Animals: Regarding animals for prizes, roadside sales, and businesses.

Texas Department of Licensing & Regulation for Licensed Breeders

Anyone who possesses five or more adult intact female dogs or cats and breeds them for direct or indirect sale must have a license from TDLR. Exceptions to the law exist.
