For fee purposes, acreage is rounded
up at .5 acre and down at .49 acre. Application fees vary with the ten
special purpose districts.
Zoning questions should be directed
to the Development Services Desk (DSD, ph: 817.459.6526). The Desk is
staffed during regular business hours (Monday-Friday
8:00 a.m. - 5:00 p.m.) to
answer questions, with easy access to zoning maps and the Zoning
Ordinance.
Prior to filing a request, a
pre-application meeting with a planner is strongly encouraged. During
this informal meeting, discussions will focus on whether or not the
request is appropriate in light of the proposed use, surrounding
zoning, surrounding land uses, recent zoning trends, the Comprehensive
Plan, Metroplex Center Development Strategy, and any other area plans.
Additionally, the applicant is
encouraged to set up a meeting with the Department of Public Works
to discuss potential traffic impacts from the proposed zoning change.
The Department of Public Works will determine whether a Traffic
Impact Analysis (TIA) or a Traffic Circulation Analysis (TCA) is
required. If required, the TIA or TCA must be submitted 15 days prior
to the Planning and Zoning Commission meeting.
The following information is required
on an application form before it may be accepted:
- Accurate legal description of the
property being rezoned;
- Requested zoning and proposed use;
- Acreage;
- Applicant's signature and phone
number;
- Property owner's signature and
phone number; and,
- Notary's signature and seal.
Additionally, the applicant must
complete a Disclosure of Interest Form
noting any potential conflicts of interest in the case by the Council,
boards and commissions, and key city staff members.
At the time of zoning case
acceptance, the applicant receives rezoning sign(s) to be placed on
the property to be rezoned. Written instructions are also provided on
how to place the sign(s). The applicant must place the sign(s) at
least one week prior to the Planning and Zoning Commission public
hearing. If the applicant is unable to place the sign(s), the planning
staff will place the sign(s) for an additional fee of $100.
The Department of Community Development and Planning is responsible for processing a zoning
application. Planning staff act as facilitators of the Comprehensive
Plan and serve as liaisons between the applicant, citizens, Planning
and Zoning Commission, and City Council. The Department of Community Development and Planning also solicits information from other
development departments, such as Public Works, Fire, and
Utilities.
The Planning Staff will field check
the site and surrounding area for relevant information such as
surrounding land uses, topography, and thoroughfares.
Based on this data, and other
information such as adopted city policies and zoning trends, the
Department of Community Development and Planning will write a staff
report to assist the Planning and Zoning Commission and City Council
in analyzing a zoning request. This report is part of the agenda
packet which is delivered to the Commission the Friday before the
public hearing. A copy of this report is available to both the
applicant and the general public the Monday before the public hearing.
Before noon on the cutoff day, the
applicant should submit a completed application form and necessary
fees to the Department of Community Development and Planning. The
cutoff day is generally four weeks before the Planning and Zoning
Commission public hearing. A schedule of the cutoff days can be
obtained from the Development Services Desk.
At the time of submittal, the
applicant should note the zoning case number and the public hearing
date. A maximum number of six zoning requests is accepted for each
Planning and Zoning Commission agenda. If an agenda is filled, any
subsequent zoning requests are scheduled for the next available
meeting.
