Garber Decision Issued

Human Resources Director Paulette Owens-Holmes issued a written opinion today with regard to the disciplinary appeal of Police Officer Mark Garber. The opinion upholds his demotion from sergeant to police officer.

Because Office Garber’s administrative appeal rights have not been exhausted, City officials will have no further comment on the matter at this time.

Subject: Appeal of Disciplinary Action: Demotion

The purpose of this memorandum is to render a decision in response to your appeal conducted February 13–15, 2002 relating to the disciplinary action rendered by Chief Theron L. Bowman on August 17, 2001.

In evaluating your appeal, I have carefully considered the testimony and supporting documents presented in this case. I find the preponderance of the evidence supports the charges and specifications relative to conduct constituting a violation of City of Arlington Personnel Policies Sections V.B.1.c.3 – Performance of Duty (Judgment) and V.B.1.c.4.c – Performance of Duty (Planning).

I further find that the punishment rendered by Chief Theron L. Bowman to be reasonable. I therefore:

sustain the demotion.

Officer Garber, you have a right to appeal this action to the City Manager within five (5) working days, from the date of receipt of this memorandum as provided by section V.C. Discipline of the City’s Personnel Policy Manual.
